James Johnson was initially charged with first-degree capital murder, rape, robbery and kidnapping in the Brittany Willis case. After he sat in jail awaiting trial for 39 months, he was released on bail, and three months later, special prosecutor Belinda Foster dismissed all charges against Johnson but charged him with accessory after the fact to first degree murder. Johnson awaits the decision of the second special prosecutor in this case, David McFadyen
